Terms and Conditions

Below I have set out some of the key terms of sale for commissioned portraits, gift vouchers and prints in plain english.
A more detailed set of terms and conditions will be emailed to the client before an order of any kind is made.

By ordering a commissioned portrait, gift voucher or print, you agree to all the terms detailed below.  No permission is given by Zoe Mitchell in respect of the reproduction of any images or other material on this website or commissioned work. Should you wish to use an image, please contact the artist. All Rights Reserved. 

  • Portrait commissions will be accepted with a 20% booking fee (non-refundable after 14 days of booking) to secure a slot in Zoe Mitchell’s work schedule and waiting list. Once the portrait is completed you will need to pay the outstanding balance before the portrait is dispatched.

    Prints and gift certificates must be paid for in full at the time of ordering. All orders must be paid for with card or bank transfer via a Stripe invoice.

    (Please be aware that I work on a first come first serve basis and waiting times can be upwards of 6 months so if you need the portrait for a specific date it’s best to ask me about this as soon as possible.)

  • You have a 14 day cooling-off period from the date of your booking a commission in which you may cancel your order and receive your booking fee back in full. After this period your booking fee becomes non-refundable and will be retained by Zoe Mitchell to cover administration costs, mock-ups, transaction fees, and emails. However please note, once artwork has been completed and you have approved it and paid the remaining amount, there will be no refunds (this does not apply to faulty or damaged items).

  • If the client wishes to cancel after the 14 day cooling-off period, the booking fee payment amount will be retained as loss of business, to cover the artist’s time, administration, emails, mock-ups and payment fees. The client will not be required to pay remaining final payment.

    If the client wishes to cancel after they have paid the remaining amount, there will be no refunds and all monies paid will be retained by Zoe Mitchell to cover artists’ time, administration, labour, and materials used.

  • Portrait prices are as per the current published portrait price list on Zoe Mitchell’s website regardless of any older business cards or leaflets you may have. For other commissions, Zoe Mitchell will quote the client and this will be the payment required.

    In the event of a price rise, Zoe Mitchell will always honour the price shown on the website at the time the customer commissioned the portrait. The portrait is considered commissioned once Zoe Mitchell has received payment of the booking fee and has sent an email confirming the order.

  • Any currency converter used is for estimation and information only. Exchange rates will be calculated either by Stripe or as per the current exchange rates during the time of payment. Zoe Mitchell cannot be held responsible for currency rate changes.

  • If a delivery incurs any import tax, VAT, or duties the customer or client is solely responsible for these payments. Zoe Mitchell cannot be held responsible for any additional charges which may occur.

  • An anticipated date of portrait completion will be given at the time of booking. Whilst every effort will be made to meet this, it should not be regarded as an absolute guarantee. If you need the portrait for a specific date please inform me as early as possible and I will do my best to accommodate this where possible.

    Please be mindful that from September to December is my busiest time. If you would like a commission in time for Christmas, please order it as soon as possible, and remember to factor in Christmas post timings.

  • Portraits will be sent flat packed, with tracking to ensure safe and timely delivery. All commission orders are shipped securely with a tracking number to the address you provide. If the item is a gift, it can be shipped directly to the recipient. Please indicate the address at the time of order. Most commissions are dispatched within 2-3 business days of recieving payment in full and cleared funds.

  • On completion of the portrait the client is permitted to make suggestions of amendments they would like made.

    If the artist amends the portrait as suggested this will have no extra charge. However, if these alterations deviate from the original commission, an additional charge may be made to the client. Zoe Mitchell is not obligated to make any amendments.

    No amendments will be made once the portrait has been approved.

  • In the case of a standard commission, if you do not approve the finished portrait you are not required to make any further payment and the portrait will remain the property of Zoe Mitchell.

    Due to the nature of custom commissions, once the finished portrait has been approved by the client and shipped, the situations in which you may ask for a refund are limited. (See your exact terms of sale for your rights regarding this.)

  • Vouchers have a one-year expiry date from the date of purchase.

    Gift Vouchers represent a particular portrait size. The value of a gift voucher is fixed at the time of purchase and is not affected by any subsequent changes to Zoe Mitchell’s prices. E.g, If you buy a Voucher for a 10” x 12” portrait you are guaranteed a portrait of that size, regardless of whether Zoe Mitchell’s prices increase during the period you have your Voucher.

    Alternatively, Gift Vouchers can be used towards a higher priced portrait, with the difference paid by the client. In this case the client is to pay the difference before the portrait is dispatched.

    Portrait gift vouchers have no cash value and cannot be exchanged for cash.

  • Whilst every care has been taken to ensure accuracy of reproduction of prints according to their originals, the artist cannot guarantee a 100% likeness due to camera settings, the printing process and individual monitor/screen settings.

  • All portraits and prints are packaged to a very high standard, so in the unlikely event your portrait/print gets damaged in transit please photograph the packaging and portrait/print and email Zoe Mitchell immediately. The portrait/print is to be returned to Zoe Mitchell in its original packaging. Once received, the artist will create another portrait/print at no additional cost. This replacement portrait/print will be of the same subject and use the same reference photo(s) as the initial portrait/print unless Zoe Mitchell offers otherwise. The lead time will depend on Zoe Mitchell’s waiting list at the time of return. If the artist is unable to produce a replacement portrait/print, alternative options may be offered.

    If your voucher arrives damaged you must email Zoe Mitchell immediately with photographic evidence of the damage. At Zoe Mitchell’s discretion, a replacement voucher will be sent out first class via Royal Mail or with a faster delivery method.

  • Although every effort is made to ensure that the images displayed on Zoe Mitchell Art’s website are as accurate as possible, Zoe Mitchell cannot guarantee an exact colour match to the product displayed on your screen due to individual screen and colour differences.

    Zoe Mitchell retains copyright on all artwork produced and reserves the right to use paintings and drawings for Zoe Mitchell’s own promotional material. Client emails may be used in whole or part for testimonials on Zoe Mitchell’s website.
